Online Store Regulations

§ 1

Preliminary Provisions

The online store "Naturalna Świeca prosto z natury ®" available at the website https://naturalnaswieca.pl is operated by Aleksandra Wiecka, conducting business under the company name NATURALNA PRACOWNIA Aleksandra Wiecka, registered in the Central Registration and Information on Business (CEIDG) maintained by the Ministry of Economy, NIP 7842473636, REGON 360734482. Address: Aleja Druga 5, 62-200 Osiniec - Gniezno.
2. These Regulations apply to both Consumers and Entrepreneurs using the Store, defining the rules for using the online store and the procedure for concluding Distance Sales Agreements with the Customer via the Store.

 

§ 2

Definitions

  1. Consumer - a consumer as defined in Article 221 of the Civil Code (consolidated text, Journal of Laws 2019, item 1145, as amended).

  2. Seller - a natural person conducting business under the name NATURALNA PRACOWNIA Aleksandra Wiecka, registered in the Central Registration and Information on Business (CEIDG), NIP 784-247-36-36, REGON 360734482.

  3. Customer - any entity making purchases via the Store.

  4. Entrepreneur - a natural person, legal person, or organizational unit not being a legal person, whose separate statute grants legal capacity, conducting business activities in their own name, using the Store.

  5. Store - the online store operated by the Seller at https://naturalnaswieca.pl.

  6. Distance Agreement - an agreement concluded with the Customer within a structured system for concluding agreements remotely (within the Store), without the simultaneous physical presence of the parties, using one or more means of distance communication up until the conclusion of the agreement.

  7. Regulations - these store regulations.

  8. Order - a declaration of the Customer's will made via the Order Form aiming directly to conclude a Sales Agreement for a Product or Products with the Seller.

  9. Account - the customer's account in the Store, which stores the data provided by the Customer and information about the Orders placed by them.

  10. Registration Form - a form available in the Store allowing the creation of an Account.

  11. Order Form - an interactive form available in the Store that allows the Customer to place an Order, particularly by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.

  12. Cart - a software element of the Store where the Products selected by the Customer for purchase are displayed, and there is the possibility of establishing and modifying Order data, including the quantity of products.

  13. Product - a movable item/service available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.

  14. Sales Agreement - a sales agreement for a Product concluded or to be concluded between the Customer and the Seller via the online store. The Sales Agreement also includes, depending on the nature of the Product, an agreement for the provision of services or a contract for specific work.

§ 4

Technical Requirements

To use the Store, including browsing its assortment and placing orders for Products, the following are required:

  • A device with internet access and an internet browser (e.g., Google Chrome, Firefox, Internet Explorer),
  • An active email account,
  • Enabled cookies support,
  • Installed FlashPlayer.

§ 5

General Information

To the fullest extent permitted by law, the Seller is not liable for disruptions, including interruptions in the operation of the Store caused by force majeure, unlawful actions by third parties, or incompatibility of the Store with the Customer's technical infrastructure.
Browsing the Store’s assortment does not require creating an Account. The Customer can place orders for Products in the Store either by creating an Account in accordance with § 6 of the Regulations or by providing the necessary personal and address data to complete the Order without creating an Account.
Prices in the Store are quoted in Polish zlotys and are gross prices (including VAT).
The final amount payable by the Customer includes the price for the Product and the delivery cost (including transport, delivery, and postal services), which the Customer is informed about on the Store's pages during the ordering process, including at the moment of expressing the intention to conclude the Sales Agreement.
In the case of an agreement involving a subscription or the provision of services for an indefinite period, the final price is the total price covering all payments for the billing period.
When the nature of the subject of the Agreement does not allow for the reasonable calculation of the final price in advance, information on how the price will be calculated, as well as costs for transport, delivery, postal services, and other charges, will be provided in the Store's description of the Product.

§ 6

Creating an Account in the Store

To create an Account in the Store, the Customer must fill out the Registration Form. It is necessary to provide the following data: first name, last name, email address, phone number, and address.
Creating an Account in the Store is free.
Logging into the Account is done by entering the login and password set in the Registration Form.
The Customer has the option to delete their Account at any time, without providing a reason and without incurring any fees, by sending a request to the Seller, particularly via email or in writing to the addresses provided in § 3.

§ 7

Order Placement Rules

To place an Order, the Customer must:

  • Log into the Store (optional);
  • Select the Product subject to the Order, then click the “Add to Cart” button (or equivalent);
  • Log in or opt to place the Order without registration;
  • If choosing to place the Order without registration, fill out the Order Form by entering the recipient’s data and the address for Product delivery, select the type of shipment (method of delivery), enter invoicing data if different from the recipient’s data;
  • Click the “Order and Pay” button and confirm the order by clicking the link sent in the email;
  • Choose one of the available payment methods and, depending on the payment method, pay for the order within the specified time, subject to § 8, point 3.

§ 8

Offered Delivery and Payment Methods

The Customer may choose the following delivery or pickup methods for the ordered Product:

  • Courier delivery,
  • Self-pickup.

The Customer may choose from the following payment methods:

  • Payment by bank transfer to the Seller's account,
  • Electronic payments,
  • Online payments,

Online payments on our store are handled by PayPal,

If a refund is required for a transaction made by the Customer via a payment card, the Seller will make the refund to the bank account linked to the Customer's payment card.

 

§ 9

Execution of the Sales Agreement

The conclusion of the Sales Agreement between the Customer and the Seller occurs after the Customer has placed an Order using the Order Form in the Online Store in accordance with § 7 of the Regulations.

After placing the Order, the Seller promptly confirms its receipt and simultaneously accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for execution occurs through the Seller sending the Customer a corresponding email to the email address provided during the Order placement. This email includes at least the Seller's statements about receiving the Order and accepting it for execution, as well as confirming the conclusion of the Sales Agreement. Upon receiving this email, the Sales Agreement between the Customer and the Seller is concluded.

In the case of the Customer choosing:

  • payment by bank transfer, electronic payments, or credit card payment, the Customer is obligated to make the payment within 5 calendar days from the date of conclusion of the Sales Agreement – otherwise, the order will be canceled. If the Customer chose a delivery method other than personal collection, the Product will be sent by the Seller within the time specified in its description (subject to paragraph 5 of this section), in the manner chosen by the Customer during the Order placement. In the case of ordering Products with different delivery times, the longest stated delivery time will apply.

For orders paid by bank transfer or credit card payment, the order execution time is counted from the date the Seller’s bank account or settlement account is credited.

In the case of ordering Products with different delivery times, the Customer has the option to request partial deliveries or delivery of all Products once the entire order is completed.

The delivery term for the Product to the Customer begins as follows:

  • In the case of payment by bank transfer, electronic payments, or credit card – from the date the Seller's bank account is credited.
  • In the case of cash on delivery – from the date of conclusion of the Sales Agreement.
  • In the case of personal collection of the Product, the Product will be ready for pickup by the Customer within the time specified in the Product description. The Customer will be additionally notified by the Seller of the readiness for pickup through an email to the address provided during the Order placement or by phone.

In the case of ordering Products with different pickup times, the Customer has the option to pick up the Products in parts (according to their readiness) or to collect all Products after the entire order is completed.

The start of the pickup readiness period for the Product is as follows:

  • In the case of payment by bank transfer, electronic payments, or credit card – from the date the Seller's bank account is credited.
  • In the case of cash on personal pickup – from the date of conclusion of the Sales Agreement.

Delivery of the Product takes place only within Poland. Shipping outside Poland is possible upon prior phone/email contact.

Product delivery to the Customer is chargeable unless the Sales Agreement provides otherwise. Delivery costs (including transportation, delivery, and postal service fees) are indicated to the Customer on the Online Store pages in the "Delivery Costs" section and during the Order placement process, including when the Customer expresses the intent to conclude the Sales Agreement.

Personal collection of the Product by the Customer is free of charge.

In the case of payment by bank transfer or credit card payment, the order execution time is counted from the date the Seller's bank account or settlement account is credited.

 

§ 10

Right of Withdrawal from the Agreement

A Consumer, and from January 1, 2021, also a natural person entering into an agreement directly related to their business activity, where the agreement does not have a professional character based on the subject of the business activity registered in the Central Registration and Information on Business Activity, has the right to withdraw from the Agreement concluded with the Seller through the Online Store within 14 days without giving any reason.

The term for withdrawal starts from the delivery of the Product to the Consumer or a person indicated by them, other than the carrier.

In the case of an Agreement covering multiple Products delivered separately, in parts, or in batches, the term referred to in paragraph 1 runs from the delivery of the last item, batch, or part.

In the case of an Agreement for the regular delivery of Products over a specified period (subscription), the term referred to in paragraph 1 runs from taking possession of the first item.

The Consumer may withdraw from the Agreement by submitting a statement of withdrawal to the Seller. To meet the withdrawal deadline, it is sufficient for the Consumer to send the statement before the end of the deadline.

The statement can be sent via traditional mail, fax, or electronically by sending the statement to the Seller’s email address or by submitting it on the Seller’s website – the Seller’s contact details are provided in § 3. The statement can also be made on the form provided in Appendix No. 1 to these Regulations, as well as the annex to the Act of May 30, 2014, on Consumer Rights, although this is not obligatory.

If the statement is sent by the Consumer electronically, the Seller will promptly send confirmation of receipt of the withdrawal statement to the Consumer’s email address.


Effects of Withdrawal from the Agreement:

In the case of withdrawal from a distance Agreement, the Agreement is considered not concluded.

If the Consumer withdraws from the Agreement, the Seller will immediately, no later than 14 days from the day of receiving the Consumer's withdrawal statement, return all payments made by the Consumer, including delivery costs, except for additional costs resulting from the Consumer’s choice of a delivery method other than the cheapest regular delivery offered by the Seller.

The Seller will refund the payment using the same payment method the Consumer used in the original transaction, unless the Consumer has explicitly agreed to another solution that will not incur additional costs for them.

The Seller may withhold the refund until the Product is returned or until proof of its return is provided, depending on which event occurs first.

The Consumer should return the Product to the address provided in these Regulations without delay, no later than 14 days from the day the Consumer informed the Seller about withdrawal from the Agreement. The deadline is considered met if the Consumer sends the Product before the end of the 14-day period.

The Consumer bears the direct cost of returning the Product, including costs if, due to the nature of the Product, it could not be returned by regular mail.

The Consumer is responsible only for the reduction in value of the Product resulting from using it in a way other than necessary to establish the nature, characteristics, and functioning of the Product.

In cases where the Product cannot be returned by regular mail due to its nature, information about this, as well as the costs of returning the Product, will be provided in the Product description in the Store.


Right to Withdraw from the Distance Agreement does not apply to the Consumer in relation to Agreements:

  • in which the subject matter is a non-prefabricated item, made according to the Consumer's specifications or serving to satisfy their individualized needs,
  • in which the subject matter is a product delivered in a sealed package that cannot be returned due to health protection or hygiene reasons if the packaging was opened after delivery,
  • in which the subject matter is a product that deteriorates rapidly or has a short shelf life,
  • for services, if the Seller has fully performed the service with the explicit consent of the Consumer, who was informed before the service started that after the performance of the service by the Seller, the right to withdraw from the Agreement will be lost,
  • where the price or remuneration depends on fluctuations in the financial market over which the Seller has no control, and which may occur before the withdrawal deadline,
  • in which the subject matter is items that, due to their nature, are inseparably mixed with other items after delivery,
  • for alcoholic beverages whose price was agreed upon at the time of the conclusion of the Agreement, and whose delivery can only take place after 30 days and whose value depends on fluctuations in the market beyond the Seller’s control,
  • for sound recordings, video recordings, or computer programs delivered in a sealed package, if the package has been opened after delivery,
  • for the delivery of newspapers, periodicals, or magazines, except for subscription agreements,
  • for the delivery of digital content that is not stored on a physical medium, if the provision of the service has begun with the explicit consent of the Consumer before the withdrawal deadline and after the Consumer was informed by the Seller about the loss of the right to withdraw from the Agreement.

 

§ 11

Complaints and Warranty

The Sales Agreement covers new Products. The Seller is obligated to deliver the Product to the Customer free from defects.

If a defect occurs in the product purchased from the Seller, the Customer has the right to file a complaint based on the warranty provisions in the Civil Code. If the Customer is an Entrepreneur, the parties exclude liability for warranty.

Complaints should be submitted in writing or electronically to the Seller’s contact details provided in these Regulations.

It is recommended to include in the complaint a brief description of the defect, the circumstances (including the date) of its occurrence, the Customer's details, and the Customer's demand regarding the defect in the product.

The Seller will respond to the complaint within 14 days, and if they do not respond within this period, the complaint will be considered justified.

Products sent as part of the complaint procedure should be returned to the address provided in § 3 of these Regulations.

 

§ 12

Alternative Dispute Resolution and Claim Enforcement

Detailed information on the possibility for the Consumer to use alternative dispute resolution methods and claim enforcement, as well as how to access these procedures, can be found at the offices and websites of local consumer ombudsmen, social organizations that protect consumers, Provincial Inspectorates of the Trade Inspection, and at the following websites of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/sprawy_indywidualne.php; and http://www.uokik.gov.pl/wazne_adresy
